The sense of loss can be unbearable and the death of a spouse, family member, friend or co-worker can be one of the most traumatic and <a href="https://www.stress.org/holmes-rahe-stress-inventory">stressful events</a> any of us will face.</p>
<p>It’s a blur of emotion, questions and pain. And while the loss of a loved one is always painful, it’s even worse when the circumstances of that loss seem to have been unnecessary, avoidable and in many ways, wrong. These deaths are often sudden, senseless, confusing and painful for those left behind who often find themselves asking “Why?” and feeling lost.</p>
<p>And in many cases those survivors are left facing psychological trauma and financial hardship, which only add to the feelings of loss.</p>
<p>Too often, survivors don’t think about their legal options in the aftermath of a sudden loss and may not realize the situation is a <a href="https://www.law.cornell.edu/wex/wrongful_death">wrongful death</a>, that is a death caused intentionally, accidentally or through negligence. 										<content:encoded><![CDATA[<p>The Coronavirus pandemic has had wide-ranging effects on nearly every aspect of life in the U.S. One of those effects is that since the pandemic began nearly a year and half ago, businesses of all types have gone to remote work arrangements, reduced hours of operations or closed entirely. Of course, more businesses are now offering delivery service than ever.</p>
<p>Today, roughly 40 percent of vehicles on U.S. roads are company owned. As those vehicles are often in operation eight hours per day or more, they log well over 40 percent of the miles driven daily (nearly 8 billion miles per day) on U.S. roads.</p>
<p><a href="https://www.automotive-fleet.com/303123/fleet-safety-metrics-reverse-negatively-accidents-increase">Company vehicle drivers average between 20,000 and 25,000 miles driven per year</a>, nearly twice the mileage driven by drivers of non-company vehicles. Obviously, this means a significant percentage of traffic accidents involve company vehicles.</p>
<h2><strong>A Company Vehicle Accident Can be Different from Accidents Involving Private Parties</strong></h2>
<p>A grocery store parking lot fender bender can be rather simple to settle in terms of liability. One party or the other admits fault; that party’s insurance company is notified and handles compensation for damage to the vehicles, rental cars, medical expenses and any other losses incurred by either party in the accident.</p>
<p>If the two drivers cannot agree on who was at fault, the insurance companies may analyze the accident and assign fault to either driver or divide fault. <a href="https://www.law.cornell.edu/wex/liability">Liability</a>, that is, who bears financial responsibility for damages is then assigned accordingly.</p>
<p>But liability for damages associated with accidents involving a commercial or company vehicle can be <a href="https://www.nolo.com/legal-encyclopedia/employer-liability-for-employee-car-accidents.html">less than clear</a>. If you’re driving a company vehicle for company purposes (such as making a delivery or picking up supplies for example) and are involved in an accident, you most likely will not be held personally liable for damages to any vehicle involved in the accident or for any injuries caused by the accident.</p>
<h2><strong>Was the Driver of the Company Vehicle “On the Job?”</strong></h2>
<p>Even if you’re driving a company vehicle for example, to go to lunch and stop to pick up something for your employer and are involved in an accident, you will likely not be held liable.</p>
<p>However, if you’re driving to work or heading home from work and are involved in no work-related activity on the drive, you may be held personally liable for damages caused by the accident – if it is determined you were <a href="https://www.findlaw.com/injury/car-accidents/fault-and-liability-for-motor-vehicle-accidents.html">negligent</a>. And in some cases employers have sought to recover damages from their own employees in these cases.</p>
<h2><strong>Doesn’t Insurance Take Care of Everything?</strong></h2>
<p>While some companies are self-insured, most carry <a href="https://www.findlaw.com/smallbusiness/liability-and-insurance.html">insurance</a> on their vehicles, but that doesn’t always simplify matters. If you were involved in an accident with a driver of a company vehicle who was driving the vehicle outside of normal work-related functions, that driver’s personal insurance company may be liable for your damages – or a portion of them.</p>
<p>In addition, some insurers are extremely aggressive in denying claims in order to reduce their costs. It is not uncommon for a driver who was involved in an accident with a company vehicle to end up facing delays in being compensated while the insurance company “investigates” the accident and works to determine who was negligent.</p>
<h2><strong>You’ve Been Involved in an Accident with a Company Vehicle; What Should You Do?</strong></h2>
<p>Keep in mind the above information is a brief overview of liability in accidents involving company vehicles. Volumes could be – and have been – written on this area of law.</p>
<p>This is because countless variables enter the “liability equation.” Was the vehicle being driven for work-related purposes? Was the driver of the company vehicle at fault? Did he or she violate any traffic laws and cause the accident? Was the driver of the company vehicle impaired? And remember; laws affecting liability in an accident involving a company vehicle can vary from state to state.</p>

<p>The limitations range from one to six years, with one year in states such as <a href="https://www.findlaw.com/injury/accident-injury-law/time-limits-to-bring-a-case-the-statute-of-limitations.html">Kentucky and Tennessee to six years, as in Maine and North Dakota.</a></p>
<p>In some states, the statute of limitations for plaintiffs who are minors at the time of their injury begins when the minor plaintiff turns 18. This means a 17-year-old in a state with a five-year statute of limitations has until five years after his or her 18<sup>th</sup> birthday (23 years old) to file suit.</p>
<h2>When the Injury is Discovered Matters</h2>
<p>When the statute of limitations “clock starts” for filing suit can be impacted by when the injury is actually discovered.</p>
<p>Following some surgeries, a patient may be bothered by persistent pain or discomfort for months or even years before discovering that the surgeon who performed the surgery left a sponge, temporary bandage, or other foreign object in the body, causing ongoing health problems and pain.</p>
<p>In these cases, most state’s statutes of limitations would be determined based on the date on which the foreign object was discovered.</p>
<h2>Time is Not the Plaintiff’s Friend</h2>
<p>While there are exceptions that can change a statute of limitations, victims of personal injuries should realize that the negligent party’s first – and best – line of defense is going to be the expiration of the statute of limitations for filing a claim.</p>

<h2><strong><u>Find out where the vehicles are being taken—The “Black Box”</u></strong></h2>
<p>Today’s cars and trucks hold a wealth of information from a crash in their “black box.”  But all too often, that black box information disappears.  Finding where every vehicle in the crash is taken enables us to get an engineer to the scene to download and preserve the information from each car.  This information is invaluable, as it often contains vehicle speed, brake pedal application information, airbag deployment information and other data that can make or break a case.  We can get experts to the vehicle before it disappears.</p>
<h2><strong><u>Talk to the Witnesses</u></strong></h2>
<p>Police and Highway Patrol officers will talk to witnesses, but often at a surface level.  We need details to prove your case.  Recorded statements are always best.  Make sure to get all contact information for each witness, because we usually talk to our witnesses multiple times during a case.  We need their story.</p>
<h2><strong><u>DON’T talk to Insurance Companies</u></strong></h2>
<p>While it is fine to tell your or your family’s insurance carrier that there was a crash, DO NOT give them any kind of a statement.</p>

										<content:encoded><![CDATA[<p>For those of you who have seen our new billboard (shout out to our models Ramona and Pecher), you have probably seen the phrase “It’s not an accident, if it was someone’s fault.” Why did we choose that phrase?</p>
<p>Because so often at our firm and in our day to day lives, we encounter people who have been in car accidents but don’t bother to follow up with an attorney. Or they go the extra step and file a claim with their insurance company. Or they pay the fines versus going to court to dispute.</p>
<p>We hear, “Well it was just an accident. It happens to everyone.”  Yes, it does happen to everyone. But most of the time, a car accident is due to the negligence or an action by one (or both) of the drivers.</p>
<h2>Who Is At Fault?</h2>
<p>A common misconception is that if you are at fault in a car accident, you can’t recover damages for your injuries.</p>
<p>This is not necessarily the case. Missouri law uses a Comparative Fault system, which decides how the damages from the crash will be divided among all parties (both the defendant and the plaintiff drivers).</p>
<p>This requires each party to take responsibility for the damages incurred during the accident.</p>
<p>Based on the damage location on the vehicle, accounts taken from eyewitnesses and the crash report, the insurance company could determine that one person was 100% at fault.</p>
<p>However, if this was a multi-vehicle collision or there was negligence from both drivers, the fault could be split accordingly amongst all the parties.</p>
<p>For example, let’s say both drivers were looking at their phones at a stop sign and they ran into each other in the intersection. Based on the damage to the car, the negligence of both drivers and injuries occurred, the insurance company decided it was a 50/50 split on fault.</p>
<p>That means Driver A’s insurance company would pay 50% of the damages and injuries incurred for Driver B and Driver B’s insurance company would pay 50% for Driver A’s damages and injuries.</p>
<h2>But I Don’t Want To Sue Anyone…</h2>
<p>We addressed this last year in our blog “<a href="https://marlerlawpartners.com/personal-injury/but-i-dont-want-to-sue-my-friend/">But I don’t want to sue my friend…”</a></p>
<p>Take it from Scott Pecher, who spoke with a friend who didn’t want to pursue action over a crash fatality. He explained to them that filing a claim with insurance was not the same as suing someone over the accident.</p>
<p>“The conversation continued as I explained that filing a claim with an insurance company does not equal a lawsuit.  A lawsuit usually only happens when the insurance company has denied or undervalued a claim, you think they’re wrong, and you choose to file paperwork in Court.  That’s a lawsuit!  A claim, meanwhile, is basically a discussion with and evaluation by an insurance company.”</p>

<p><strong>Before you give a statement</strong>, there are some things you will want to consider:</p>
<ol>
<li>Is the claim more likely to be against you or on your behalf?</li>
<li>Is the adjuster part of your insurance company, or the other party’s?<br />
<span class="sub-point"><strong>a)</strong> If it’s the other party’s, be very cautious as they have the financial motive to manipulate your statement in a way that favors their driver.</span></li>
<li>Have you first consulted with your own insurance company?</li>
<li>Is it a serious enough claim (for example, personal injury to you or the other party) that you would need to consult with an attorney?</li>
<li>Do you have all the information in front of you that the insurance adjuster has, such as a police report?</li>

And, just when you think it’s all settled, that’s typically when the medical bills start rolling in. </span></p>
<p class="p3"><span class="s1">If you or someone you knew was in this scenario, wouldn’t you want to help your family’s financial stress by filing a claim? </span></p>
<h3 class="p1"><span class="s1">What to Expect</span></h3>
